1. Object
These general terms and conditions of sale (hereinafter referred to as “GTC”) govern all sales of website creation and hosting services made by Web 4 Live via the website web4live.com. They apply to all orders placed on the website web4live.com.
2. Acceptance of the General Terms and Conditions
The customer acknowledges having read these General Terms and Conditions and accepts them fully and without reservation. The General Terms and Conditions prevail over any other general or specific conditions not expressly agreed to by Web 4 Live.
3. Orders
Orders can be placed on the website web4live.com. Web 4 Live reserves the right to refuse any order in the event of a dispute with the customer, technical problems during the migration of a site or any other legitimate reason. Confirmation of the order implies full acceptance of these General Terms and Conditions.
4. Rates and Payment
Rates are indicated in euros, all taxes included (TTC). The customer can choose to pay annually or monthly. In the event of non-payment, Web 4 Live reserves the right to suspend access to the site without notice and to claim damages. Payment can be made by credit card, bank transfer or other means offered on the site.
5. Delivery
Web 4 Live undertakes to deliver the website within the agreed deadlines from receipt of payment. Delivery consists of making the necessary files available on the customer's storage space or by another agreed method.
6. Web Hosting
Web 4 Live offers a dedicated or cloud WordPress hosting service, provided by IONOS, with specific technical specifications: 6-core AMD processor, 32 GB of RAM, up to 1 TB of storage. The service includes full monitoring, bandwidth up to 1 GB/s, and a connection to the Cloudflare CDN. No mailbox is included in the hosting. Web 4 Live can however connect a professional domain to a mailbox for an additional cost of €5 per mailbox.
7. Intellectual Property and Payment Terms
Website creation services, including media files, images, videos, and WordPress code, remain the property of Web 4 Live until full payment of the agreed price. The client agrees to pay the website creation fees according to a monthly payment plan over a period of 12 months.
Property Rights: The website created will only become the property of the client after payment of the 12th monthly payment. Until payment has been made in full, Web 4 Live retains full rights to the site. In the event of non-payment at any stage of the payment plan, Web 4 Live reserves the right to suspend access to the site or even to keep the site until full payment is received.
8. Responsibilities
The customer is responsible for any changes made to the site after its delivery. In the event of a technical problem due to these changes, Web 4 Live may charge troubleshooting fees. Web 4 Live cannot be held responsible for indirect damages or service interruptions due to external causes.
9. Confidentiality and GDPR
Web 4 Live is committed to respecting the confidentiality of the customer's personal data, in accordance with the GDPR. The data will only be used for the purpose of fulfilling the order and providing customer support. The customer has the right to access, rectify and delete their data.
10. Right of Withdrawal
In accordance with article L.221-28 of the Consumer Code, the customer does not benefit from a right of withdrawal for the purchase of a personalized website.
11. Disputes
In the event of a dispute, an amicable solution will be sought before any legal action. In the absence of an agreement, the dispute will be submitted to the competent courts under French law.
12. Right of Refusal and Closure
Web 4 Live reserves the right to refuse any customer or close a site in the event of non-payment, illegal acts (such as hacking), or other behaviors that endanger the security of the server or other customers. In the event of prolonged non-payment (beyond 12 months), Web 4 Live reserves the right to keep the site until full payment.
13. Suspension of the Site in the Event of Non-Payment of the Monthly Subscription
The customer agrees to pay the monthly subscription for the website hosting and maintenance services, as agreed upon when subscribing. In the event of non-payment of the monthly subscription on the due date, Web 4 Live reserves the right to immediately suspend access to the website.
Suspension and Reactivation:
- If payment is not made within 7 days of the due date, Web 4 Live will suspend the site. During this period, the site will be inaccessible to the public and the customer.
- The website will only be reactivated after receipt of full payment of all amounts due, including any late or reactivation fees.
Site Conservation:
- During the suspension period, Web 4 Live retains all files and data on the site. However, if the non-payment situation persists beyond 30 days without resolution, Web 4 Live reserves the right to remove the site from its servers.
- If the customer regularizes his situation after the suspension but before the deletion, the site will be reactivated within 48 hours after confirmation of payment.
14. Commencement of the Contractual Relationship
The customer formally becomes a customer of Web 4 Live as soon as he begins to use the company's services, that is to say as soon as his site is connected to the server and hosting begins, even in the absence of creation of a formal customer account. This use of the services constitutes full and complete acceptance of these General Terms and Conditions of Sale (GTC).
15. Validation of the Contract
Validation of the contract for Web 4 Live services may be done through various means of communication, including, but not limited to:
- Acceptance of the General Conditions of Sale (GCS) by creating an account on the website4live.com.
- Express acceptance by email in response to the sending of the T&Cs or the commercial offer.
- Explicit consent given by written message (WhatsApp, SMS, etc.).
- Oral confirmation, followed by written validation (email, SMS, etc.).
- Electronic signature via a recognized signature platform.
The customer acknowledges that from the moment he accepts the conditions by one of these means, the contract is considered formally concluded and these T&Cs are applicable.
Web 4 Live also reserves the right to create a customer account in the name of the customer with his prior consent, after which a summary of the information and conditions will be sent to him for confirmation.
